Miss Tanco Mardi Gras 2009 Rules and Regulations

The undersigned (referred to as Candidate) must comply with the following rules and regulations of the Miss Tanco Mardi Gras 2009 program:
1. Candidate must be at least 21 years of age and a citizen of the United States. Candidates must provide two (2) forms of identification.
2. Candidate must not be under contract with any person, firm or corporation that would prevent her appearance or participation in the Miss Tanco Mardi Gras 2009 events.
3. Candidate must never have been convicted of a crime or have any criminal charges pending against her, and be of good moral character.
4. Candidate may not consume any alcoholic beverages, use illegal drugs or publicly smoke during any of the Miss Tan Co Mardi Gras 2009 events, including the selection process. Candidate will conduct herself in a courteous, professional manner at all times during all of the Miss Tanco Mardi Gras 2009 events.
5. Candidate may not be employed by TheTanco, Inc., its affiliates or related companies. Immediate family members of employees of TheTanco, Inc., its affiliates and related companies are ineligible to compete in the Miss Tanco Mardi Gras 2009 program.
6. Candidate must be present to submit her entry for the Miss Tanco Mardi Gras 2009 program at 8:00 p.m. (CST) on December 12, 2008 at Big Daddys in Soulard. In lieu of an entry fee for the Miss Tanco Mardi Gras 2009 program, Candidate shall conduct fundraising efforts to collect contributions for the D-Feat Breast Cancer campaign. Candidates shall submit to TheTanco, Inc. all contributions for the D-Feat Breast Cancer campaign at the initial Miss Tanco Mardi Gras 2009 event on December 12, 2008 in order to continue participation in the program. The twenty-five (25) Candidates who raise the most money for the D-Feat Breast Cancer campaign will move on to the next round of the Miss Tanco Mardi Gras 2009 program. Ten (10) finalists will be selected from the twenty-five finalists by a web vote on www.thetanco.com. Miss Tanco Mardi Gras 2009 and two (2) runners-up will be selected from the ten (10) finalists following an interview with a panel of judges. The decision of the judges is final, absolute and binding. TheTanco, Inc. has the final decision in choosing the winner.
7. TheTanco, Inc., its affiliates, related companies, sponsors and their respective directors, officers, partners, employees, agents and assigns are not responsible in any manner whatsoever for any delays or non-receipt of Candidates entry.
8. The schedule of events and qualification rounds are subject to change at the absolute discretion of TheTanco, Inc. and sponsors of the Miss Tanco Mardi Gras 2009 program. TheTanco, Inc., its affiliates, related companies, sponsors and their respective directors, officers, partners, employees, agents and assigns are not responsible, accountable or liable in any manner whatsoever for any direct or consequential loss, personal injury or damage to anyone or anything arising from the cancellation or change in dates of the Miss Tanco Mardi Gras 2009 events or change in the rules and regulations of the Miss Tanco Mardi Gras 2009 program.
9. Candidate must be available to attend all rehearsals and Miss Tanco Mardi Gras 2009 events. (For a complete list of events please visit www.thetanco.com/mardigrasevents). Candidate is responsible for her transportation to and from all events and any associated costs, including lodging.
10. The rules and regulations of the Miss Tanco Mardi Gras 2009 program may be changed from time to time by TheTanco, Inc. without notice.
11. Candidate will be disqualified and forfeit all awards and privileges if she fails to comply with any rule and regulation of the Miss Tanco Mardi Gras 2009 program. Any misrepresentation by Candidate will result in disqualification, whether discovered prior to, during or after the selection of Miss Tanco Mardi Gras 2009 and the Candidate shall be liable to TheTanco, Inc. for such misrepresentation. In the event of disqualification of Miss Tanco Mardi Gras 2009, the title will pass to the runners-up in order of their rank, beginning with the first runner-up. Such disqualification may not be appealed and the decision of TheTanco, Inc. shall be final.
12. Candidate irrevocably consents and agrees to unrestricted use by TheTanco, Inc., its affiliates, related companies and their respective its authorized representatives, advertisers, successors, sponsors, customers and assigns of the Candidates name, likeness, voice and/or biography. Candidate waives the right to inspect or approve such uses of her name, likeness, voice and/or biography.
13. All prizes are subject to deduction of tax at source and all other taxes, as required by law.
14. TheTanco, Inc., its affiliates, related companies, sponsors and their respective directors, officers, partners, employees, agents and assigns are not responsible for any direct or consequential loss or any physical injury which Candidate may sustain on account of her participation in the Miss Tanco Mardi Gras 2009 program. Candidate participates at her own risk and liability and shall have no claim whatsoever on any account against TheTanco, Inc., its affiliates, related companies, sponsors and their respective directors, officers, partners, employees, agents and assigns.

DO NOT SUBMIT THIS FORM UNTIL YOU HAVE READ THE ABOVE APPLICANT STATEMENT
I certify that I have read and agree to abide by the rules and regulations of the Miss Tanco Mardi Gras 2009 program. I further agree to strictly abide by the rules and regulations set forth above and agree to indemnify TheTanco, Inc., its affiliates, related companies, sponsors and their respective directors, officers, partners, employees, agents and assigns against any and all claims and/or damages that may occur directly or indirectly as a result of my default.

I hereby release and discharge TheTanco, Inc., its affiliates, related companies, sponsors and their respective directors, officers, partners, employees, agents and assigns from any liability, claim, demand, costs, damages, expenses, loss of service, opportunity or consequential damages arising out of any act, omission or event arising from my participation in the Miss Tanco Mardi Gras 2009 program.
